EPF Dispute in Kolkata: How to Claim PF, Pension, and Grievances

The Employees Provident Fund (EPF) is one of the most important social security benefits available to salaried employees in India. Yet, for thousands of employees in Kolkata and across West Bengal, claiming PF, transferring accounts, or resolving disputes with employers and the EPFO can be a frustrating experience. Delays in PF withdrawal, incorrect PF passbook entries, employer failure to deposit PF contributions, and pension disputes are common issues. At FileX Advocates & Legal Consultants, we help employees and employers in West Bengal navigate EPF disputes effectively, whether through the EPFO grievance portal, the Employees Provident Fund Appellate Tribunal (CPAT), or the Calcutta High Court.

Understanding the EPF Framework in West Bengal

The Employees Provident Funds and Miscellaneous Provisions Act, 1952 governs the EPF scheme in India. In West Bengal, the Employees Provident Fund Organisation (EPFO) operates through its Regional Office in Kolkata, located at Bhavani Senani Bhavan, P-1, Hyde Lane, Dalhousie, Kolkata. The EPFO West Bengal region covers all establishments in the state and is headed by the Regional Provident Fund Commissioner (RPFC).

The EPF scheme has three components:

  • EPF (Employee Provident Fund): The employee contributes 12% of basic wages and dearness allowance, and the employer contributes an equal amount (3.67% to EPF and 8.33% to EPS).
  • EPS (Employee Pension Scheme): The employer contribution of 8.33% goes towards pension, which the employee receives after retirement at age 58 (now reducible to 50 with reduced pension).
  • EDLI (Employee Deposit Linked Insurance): A life insurance benefit linked to the PF balance, providing up to seven lakh rupees to the nominee on the death of the employee.

Common EPF Disputes in Kolkata

Based on our experience handling EPF cases in West Bengal, the most common disputes include:

  • Employer not depositing PF contributions: Despite deducting PF from salary, the employer fails to deposit the amount with EPFO. This is a serious violation under Section 18 of the EPF Act.
  • Delay in PF withdrawal: Claims filed online through the UAN portal get rejected or stuck for months due to mismatch in KYC, incorrect bank details, or employer not approving the claim.
  • PF transfer disputes: When changing jobs, the PF balance from the previous employer is not transferred to the new account, causing loss of interest and pension continuity.
  • Pension disputes: Incorrect pension calculation, rejection of pension claim on grounds of insufficient service, or disputes over the pensionable salary.
  • Eligibility disputes: Employer denies PF coverage claiming the establishment has fewer than 20 employees or the employee is not eligible.
  • Less wages shown: Employer shows a lower basic wage than actual to reduce PF contribution, violating the definition of "basic wages" under the Act.

How to Check PF Status and File Grievances

The first step in resolving any EPF dispute is to check your PF passbook and UAN status. The EPFO provides the following online tools:

  1. EPFO Member Portal (members.epfindia.gov.in): Log in with your UAN and password to check your passbook, claim status, and KYC details.
  2. EPFiGMS (Grievance Management System): File a grievance at epfigms.gov.in. Select the grievance type, enter your UAN, and describe the issue. The EPFO must respond within thirty days.
  3. CPGRAMS: If the EPFiGMS complaint is not resolved, escalate to the Centralized Public Grievance Redress and Monitoring System (pgportal.gov.in).
  4. RTI Application: File an RTI with the EPFO Regional Office, Kolkata, to get information about your PF account, deposit status, or claim rejection reasons.

Always preserve pay slips, Form 16, appointment letter, and bank statements as evidence. These documents are critical when filing a complaint or pursuing legal action.

Legal Remedies for EPF Disputes

1. Filing a Complaint with EPFO

Under Section 7A of the EPF Act, an employee can file a complaint with the RPFC, who has the power to determine the amount due from the employer and issue a recovery order. The RPFC can conduct an inquiry, examine records, and assess damages for delayed payment. The EPFO West Bengal office entertains such complaints at the regional level.

2. Appeal to the CPAT

An employer aggrieved by an order under Section 7A can appeal to the Central Government Industrial Tribunal-cum-Labour Court (CGIT), which functions as the Appellate Tribunal under Section 7-I of the Act. In West Bengal, the CGIT is located in Kolkata. The appeal must be filed within sixty days of the order.

3. Writ Petition in Calcutta High Court

If the EPFO fails to act on a grievance, or if there is an unreasonable delay in processing a claim, the employee can file a writ petition under Article 226 of the Constitution before the Calcutta High Court. The court can direct the EPFO to process the claim, release the PF amount, or take action against the employer. This remedy is particularly effective when:

  • The EPFO has rejected a claim without assigning reasons
  • The employer has not deposited PF despite a Section 7A order
  • The EPFO has not responded to a grievance within a reasonable time
  • The pension claim has been rejected on arbitrary grounds

4. Criminal Prosecution of Employer

Under Section 18 of the EPF Act, non-payment of PF is a criminal offence. The EPFO can file a prosecution before the Magistrate, and the employer can face imprisonment up to one year and fine. The Calcutta High Court has held that PF deduction is a statutory trust—the employer holds the deducted amount in a fiduciary capacity, and non-deposit amounts to criminal misappropriation.

PF Withdrawal: Procedure and Documentation

An employee in Kolkata can withdraw PF under the following circumstances:

  • Resignation or retirement: Form 19 (PF withdrawal) and Form 10C (pension withdrawal) or Form 10D (pension claim) must be filed online through the UAN portal.
  • Unemployment: After sixty days of unemployment, the full PF balance can be withdrawn. For unemployment before age 58, 75% of the pension corpus can be withdrawn after one month and the balance after two months.
  • Partial withdrawal: For marriage, education, house purchase, or medical treatment, partial withdrawal is permitted under Para 68 of the EPF Scheme.
  • Death of employee: The nominee or legal heir can claim the PF, EDLI, and pension benefits through Form 20, Form 10D, and Form 5-IF.

The documents required include Aadhaar, PAN, bank account details (cancelled cheque), and employer attestation (if Aadhaar is not seeded with UAN). The EPFO is supposed to settle claims within twenty days of submission, but delays are common in practice.

Calcutta High Court on EPF Matters

The Calcutta High Court has delivered several important judgments on EPF disputes. The court has consistently held that PF contributions are the deferred wages of the employee and the employer has no right to withhold or delay them. The court has also directed the EPFO to settle claims within the statutory timeline and has imposed costs on the EPFO for inordinate delays. In matters involving employer non-deposit, the court has directed the RPFC to invoke Section 8A (attachment of bank accounts) and Section 9 (recovery as arrears of land revenue) for recovery.

Frequently Asked Questions

How long does the EPFO take to settle a PF claim in Kolkata?

The statutory timeline for settlement of a PF claim is twenty days from the date of receipt of a complete application. However, in practice, it can take thirty to forty-five days. If the claim is delayed beyond this, you can file a grievance on EPFiGMS or approach the Calcutta High Court through a writ petition.

What can I do if my employer has deducted PF but not deposited it with the EPFO?

This is a serious offence under Section 18 of the EPF Act. You can file a complaint with the RPFC, Kolkata, who will initiate recovery under Section 8A and can also file a criminal prosecution. You can also file a writ petition in the Calcutta High Court for direction to the EPFO to take action against the employer.

Can I withdraw my PF without employer attestation?

Yes, if your Aadhaar is seeded with your UAN and KYC is complete (Aadhaar, bank, and PAN verified), you can file a claim directly without employer attestation. This was introduced by the EPFO to reduce employer dependency in the claim process.

Is there a time limit for filing a PF claim after leaving a job?

There is no specific time limit for filing a PF withdrawal claim, but it is advisable to claim within three years, as the PF account becomes inoperative after three years of no contribution, and no interest is credited thereafter. The Calcutta High Court has held that an inoperative account does not extinguish the right to claim.

What is the pension under EPS and how is it calculated?

The pension under the Employee Pension Scheme, 1995 is calculated as: (Pensionable Salary x Pensionable Service) / 70. The pensionable salary is the average of the last sixty months basic salary plus dearness allowance. The minimum pension is one thousand rupees per month, as notified by the government. The Supreme Court has upheld the right to higher pension on actual salary for employees who opted for it.
