Sample Application under Order 40 Rule 1 CPC for Appointment of Receiver

APPLICATION UNDER ORDER 40 RULE 1 OF THE CODE OF CIVIL PROCEDURE, 1908 FOR APPOINTMENT OF RECEIVER

The Plaintiff above-named most respectfully submits as follows:

1. That the Plaintiff has filed the present suit for [nature of suit].
2. That the subject matter of the suit is [description] which is likely to be wasted, damaged, or alienated if not properly safeguarded.
3. That the Defendant is likely to alienate or deal with the suit property in a manner prejudicial to the interests of the Plaintiff.
4. That it is just and convenient to appoint a Receiver to take charge of the suit property pending disposal of the suit.
5. That the Plaintiff is ready and willing to furnish security as directed by this Hon'ble Court.

Prayed that a Receiver be appointed to take charge of the suit property with power to manage, collect rents, and preserve the property pending disposal of the suit.
