Sample Application under Section 11 of the Arbitration and Conciliation Act, 1996

APPLICATION UNDER SECTION 11 OF THE ARBITRATION AND CONCILIATION ACT, 1996 FOR APPOINTMENT OF ARBITRATOR

The Applicant above-named most respectfully submits as follows:

1. That the Applicant and the Respondent entered into an agreement dated [date] which contained an arbitration clause providing for resolution of disputes through arbitration.
2. That disputes and differences have arisen between the parties in connection with the said agreement.
3. That the Applicant issued a notice dated [date] to the Respondent invoking the arbitration clause and proposing appointment of an arbitrator.
4. That the Respondent has failed to appoint an arbitrator within thirty days of the said notice.
5. That in view of the failure of the Respondent to appoint an arbitrator, the Applicant is constrained to approach this Hon'ble Court under Section 11 of the Arbitration and Conciliation Act, 1996.

Prayed that an Arbitrator be appointed to adjudicate the disputes between the parties.
