How much maintenance can I claim under Section 125 CrPC?
There is no fixed amount. The court considers: husbands income and earning capacity, wifes needs and standard of living, number of dependants, and the husbands liabilities. The Supreme Court has suggested that maintenance should be 25% of the husband net salary as a guideline, but this is not a strict rule.
What is the difference between interim and permanent maintenance?
Interim maintenance (pendent lite) is awarded during the pendency of proceedings to support the spouse while the case is ongoing. Permanent maintenance is the final award after the case concludes.
