Any co-owner of the property can file a partition suit. Under Hindu law, any coparcener (including daughters after 2005 amendment) can seek partition of ancestral property. Co-owners of purchased property can also seek partition regardless of religion.

How is property divided in a partition suit?

The court first determines the shares of each co-owner (preliminary decree), then appoints a Commissioner to physically divide the property into separate shares (final decree). If physical division is not possible, the property is sold and proceeds distributed according to shares.

What is the difference between ancestral and self-acquired property in partition?

Ancestral property (acquired by ancestors up to 4 generations) gives coparcenary rights to all descendants by birth. Self-acquired property can only be partitioned among legal heirs after the owner death, as per the will or succession law. Daughters have equal coparcenary rights in ancestral property since 2005.
